Peanut Producer Broadens Recall

The peanut producer linked to a nationwide outbreak of salmonella contamination on Wednesday expanded its recall to all products made since the beginning of 2007, the New York Times reports. The Peanut Corporation of America has already recalled more than 400 products following eight deaths and more than 500 salmonella-related illnesses. On Tuesday, federal health regulators said a Peanut Corporation plant in Georgia knowingly shipped contaminated products at least a dozen times during 2007 and 2008.

A Nevada jury has awarded $2.5 million to the family of a woman who died after a doctor failed to diagnose her with colon and rectal cancer. According to an attorney for the family, the woman would have had a 97 percent chance of survival if her doctor and other healthcare personnel would have provided a timely diagnosis. The award includes more than $2 million in compensatory damages and $350,000 in non-economic damages. The award is estimated to be the largest medical malpractice award in the state since 2004.

Family Files Salmonella-Related Wrongful Death Suit

The operators of a Georgia peanut butter plant and an Ohio distributor were negligent in the death of a 72-year-old woman, says a lawsuit filed by family members. In the lawsuit, relatives of Shirley Mae Almer claim that she died as a result of a nationwide salmonella outbreak that has been linked to the Peanut Corp. of America and distributor King Nut. The lawsuit seeks damages in excess of $50,000 against the companies.

Favorable Discrimination Law to Protect Workers

Congress gave final approval on Tuesday to a civil rights bill providing women, blacks and Hispanics with powerful new tools to challenge pay discrimination in the workplace. It is likely to be the first significant legislation signed by President Obama. The chief sponsor of the bill, Senator Barbara A. Mikulski, Democrat of Maryland, offered this advice to employers: “If you don’t want to be sued, don’t discriminate.”
In many cases, women and minorities do not realize they are being paid less than their counterparts (men, opposite race, etc.) until years after the discrimination began. At many companies, workers do not openly discuss their salaries, and pay disparities grow gradually over many years. The new law will help you recover what should have rightfully paid to you.
Under existing law, a victim of discrimination can recover up to two years of back pay. The House passed a related bill this month that would allow women to get compensatory and punitive damages for violations of the Equal Pay Act of 1963, which generally requires equal pay for equal work. Those provisions are not included in the legislation being sent to the president.

The New York Times has reported that the Peanut Corporation of America, a Georgia-based peanut butter producer linked to a nationwide salmonella outbreak, has been repeatedly cited for violating sanitation and cleanliness standards. According to reports from 2006, 2007 and 2008, the Peanut Corporation of America-owned plant failed to properly sanitize food-contact surfaces and failed to make sure that equipment was cleanable and properly designed. The salmonella outbreak has been blamed for at least 500 illnesses and seven deaths.

Pfizer Settles Off-Label Marketing Claims

Margaret Cronin Fisk of Bloomberg News has reported that Pharmaceutical giant Pfizer Inc. has agreed to pay $2.3 billion to resolve inquiries into allegations that the drug maker improperly marketed the painkiller Bextra and other drugs. In a statement released yesterday, the company said the settlement would tentatively cover all government investigations into off-label marketing practices. Earlier this month, Eli Lilly & Co. agreed to pay $1.42 billion to settle similar claims over its antipsychotic drug Zyprexa.
The settlement is the largest for claims of off-label marketing practice.

Study: Delayed Care More Likely for Women

Women complaining of heart trouble are more likely to be delayed en route to the hospital, a new study has found. According to the study, conducted by researchers at Tufts Medical Center, women were 52 percent more likely to wait after emergency personnel arrived than their male counterparts. Researchers were unable to pinpoint the cause of longer waits among the female cardiac patients surveyed. KV Pharmaceutical to recall most products

KV Pharmaceutical announced Monday that it would recall most of its products after conferring with federal safety regulators. The latest announcement follows recalls last year over fears that oversized painkiller and attention-deficit disorder tablets could deliver dangerously large dosages. The Food and Drug Administration subsequently opened an investigation into the company’s quality control standards.
Shares of KV Pharmaceutical Co. (nyse: KVA - news - people ) fell $1.64, or 73 percent, to 60 cents in morning trading. You can read more HERE.
