A California jury has ordered an Orange County Hospital to pay $2.9 million to a woman who was left with chronic pain following a 2005 hip surgery. According to the lawsuit, Dr. Guy Paiment and UCI Medical Center failed to warn the patient of potential complications associated with the surgery. Additionally the lawsuit accused the doctor and hospital of violating normal standards of care. State caps on non-economic damages will likely limit the award to several hundred thousand dollars, an attorney for the patient said.
This blog is worried about similar effects on caps in Tennessee. Caps are not a “deterrent” of physician malpractice. They are only a punishment on those unfairly injured by careless medical providers.
