Yaz® ‘s “Misleading” Marketing

Yaz®  first hit the U.S. market in 2006 after receiving FDA approval for pregnancy prevention, treatment of moderate acne in women who desire an oral contraceptive, and treatment of premenstrual dysphoric disorder (PMDD).

While PMDD and premenstrual syndrome or PMS have some common symptoms, they are different disorders. Yaz®  is not approved by the FDA for the treatment of PMS. Although Yaz®  was not approved by the FDA for the treatment of PMS, Bayer chose to air direct to consumer Yaz advertisements that according to the FDA implied that Yaz®  had been approved by the FDA for the treatment of PMS.

Drug makers are strictly prohibited from promoting their products for uses that have not been approved by the FDA, often referred to by off-label marketing.

An October 2008 warning letter to Bayer from the FDA also cited the advertising campaign’s lack of effective representation of important serious side effects associated with the use of Yaz, such as potential fatal blood clots.

Following the FDA’s warning letter and legal action involving the ads in 27 states, Bayer agreed discontinue running the deceptive ads and commit $20 million to a new ad campaign aimed at correcting misnomers that may have been spread by earlier misleading advertisements.

Unfortunately, by the time the corrective advertising began in early 2009 Yaz®  was already one of the most popular contraceptives available and millions of American women had chosen Yaz,®  based on Bayer’s advertising campaign that downplayed serious side effects associated with the use of Yaz.®

Bayer profited millions of dollars by creating an advertising campaign that over exaggerated the benefits of Yaz®  while downplaying the potential side effects associated with the medication. As a result many of women may have suffered severe side effects of a Yaz®  that never even knew existed.
