A new report is showing that state medical boards are not disciplining doctors as they likely should; the rate of disciplinary actions against doctors is 18 percent lower than the highest rate, which occurred 5 years ago. The difference amounts to approximately 653 serious disciplinary actions not taken. There is no proof that medical malpractice has reduced 18%.
The director of Public Citizen’s Health Research Group stated that there is mounting evidence showing that medical boards are under-disciplining physicians who commit medical error and are responsible for injuries to patients from medical malpractice and hospital negligence, including in Tennessee, Mississippi and Arkansas. We believe that state committees and boards must spend more time reviewing the actions of a doctor, rather than, so to speak, sweeping allegations under the rug. It may be beneficial for state legislatures to get involved and pass legislation to require discipline in certain cirumstances.
Whatever the solution, something should be done to make sure doctors pay attention to their patients and not commit preventable medical errors. The citizens of Tennessee, Mississippi and Arkansas deserve more. If you have a question about a potential medical malpractice case, we are here to listen. If you believe a physician has not been disciplined for conduct while you or a loved one was a patient, call us for help.
