On October 21, 2008 the food and drug administration issued a public health notification that described over 1,000 complaints that have been reported over a 3 year period related to vaginal sling implants. It is alleged that due to defects in design, manufacture and warnings, the Gynecare KVK-S-Gynecare proleft and Gynecare TVT-O were implanted in patients across the country in a reasonably dangerous condition. It has further been alleged that these products were defective with respect to their design, manufacture, marketing, labeling, packaging, selling and lack of appropriate necessary warnings and instructions for use. It is alleged that the above companies either knew or should have known that the medical devices implanted into patients were not reasonable fit, suitable and safe when used with their intended or reasonable foreseeable purposes. It is further alleged that the medical devices were designed and manufactured and then sold lacking adequate warnings and proper instructions for use. The foreseeable use of these transvaginal mesh slings involve significant dangers associated with inherent defects that were not readily obvious to the ordinary user of these products. The above listed companies either knew or should have known about the injuries associated with the inherent defects of these transvaginal mesh slings including but not limited to the propensity to erode bodily tissues and cause serious infectious processes.
