The Hartford Courant (7/2, Kauffman) reported, “A Superior Court jury has awarded more than $1.3 million in a medical malpractice lawsuit that had tested whether an unmarried same-sex partner could recover for loss of consortium.” On Friday, a jury in Stamford found Dr Iris Wertheim “55-percent liable” on the malpractice claims, “amounting to about $1.35 million.” Attorney Joshua Koskoff “said he was pleased with the verdict, and said he and [Charlotte] Stacey would decide whether they will challenge the ruling that rejected Stacey’s loss of consortium claim. He said that while the law does not permit a party to marry into a cause of action, [Margaret] Mueller and Stacy were prevented from marrying only on the basis of what was later deemed an unconstitutional law.”
