In continuing coverage in the New York Times (8/19) “Doctor and Patient” column, Pauline W. Chen, MD, discusses the ramifications of a medical error disclosure program in which a hospital handles “patient injuries by initiating discussions with patients and families, conducting internal investigations, and offering apologies with offers of compensation should those investigations reveal medical errors.” A study published in the Annals of Internal Medicine details the experiences of the University of Michigan Health System which, since 2001, has followed such a policy. In the study, “researchers analyzed the number of claims and lawsuits filed against the hospital system between 1995 and 2007, comparing data from before and after the policy took effect.” The study found that “there were actually fewer lawsuits and claims after the hospital began its disclosure with compensation program.”

The report is being widely disseminated by the health insurance industry, which is pushing back against claims that health insurance profits — rather than rising medical costs — are to blame for rising premiums.” In the survey, “Forbes points out that hospital charges account for about a third of healthcare spending, or $718 billion — more than any other single category.” In an earlier report, Bloomberg cited Princeton economist Alain Enthoven saying that hospital expenses rose “largely because of the pricing power of local hospital systems,” and calling for “effective antitrust enforcement.”

While reported in Oregon, not Tennessee, Mississippi or Arkansas, it is important to note that The Oregonian (8/20, Rojas-Burke) says that “at least 32 patients died as a result of preventable errors in Oregon hospitals last year,” according to a report released Thursday by the Oregon Patient Safety Commission. “Hospitals reported 136 incidents in 2009,” and in “22 percent of cases, patients suffered minimal or no detectable harm.” But “half of the incidents resulted in serious injury or death. In nine cases, a surgical team operated on the wrong body part or the wrong patient.” In addition, surgeons “accidentally left objects in patients 21 times.” Of the state’s 58 hospitals, 56 are taking part in the voluntary program.

If you or a loved one may has been diagnosed with tardive dyskinesia after years of taking the prescription drug Reglan you may be entitled to monetary compensation for what could be a permanent condition. Tardive dyskinesia is a neurological disorder that causes repetitive and involuntary movements of the lower face and limbs. Symptoms can include repeated grimacing, chewing, smacking of lips, rapid eye movements and impaired finger movements. There is no known effective treatment for the problems from metoclopramide, and the involuntary movements often persist even after use of the drug has stopped, contrary to what was suggested on the warning labels for Reglan and generic metoclopramide drugs.
