EPA Orders Payments to Asbestos Victims

The Environmental Protection Agency announced Wednesday that it will provide $6 million in funding to help residents of a small Montana town who were sickened by asbestos exposure. The announcement comes as part of the agency’s first-ever public health emergency and will cover the towns of Libby and Troy. The Department of Health and Human Services estimates that 50 new cases of asbestos-related illnesses are diagnosed in the two towns each year.  [The Washington Post].

Future Uncertain for some Asbestos Plaintiffs

More than 1,000 plaintiffs with asbestos-related claims pending against a Missouri company face an uncertain future following the announcement that the maker of heat-resistant products has filed for bankruptcy protection. Plaintiffs in cases against Christy Refractories Co. LLC include those who were exposed to asbestos in steel mills and other commercial and industrial spaces, according to one attorney. A bankruptcy court is expected to establish a trust fund for the suits until the company emerges from bankruptcy.

Asbestos Victim Awarded $3.6 Million

A woman suffering from mesothelioma caused by second-hand asbestos exposure has been awarded $3.6 million by a Florida jury. In the lawsuit, Lynda Daly claimed that she was exposed to asbestos from brakes while working at a Ford dealership and may have also been exposed by brake repairs done at her home. Attorneys on both sides said they expect the case to be appealed.

Mesothelioma Victim Challenging Court Ordered Autopsy

A man suffering from mesothelioma is challenging a court order requiring an autopsy in the event of his death. The autopsy requirement, which is part of an asbestos settlement, is unconstitutionally vague, an attorney for James Ross argues. According to the attorney, Ross objects to the autopsy because of personal moral beliefs.
