Cochlear Implant Failure Lawyer Helps Children and Adults

June 8, 2010

If you or a loved one has experienced the failure of the Advanced Bionics HiRes90k cochlear implant, attorneys Tim Edwards and Ed Wallis may be able to help you. Mr. Edwards and Mr. Wallis are currently representing both children and adults internationally who received the HiRes90k cochlear implant.

The failure of these implants is related to moisture intrusion in the device. Symptoms of failure include popping and crackling sounds inside of the implant. For young children, you may see the child remove the device suddenly and refuse to wear the device. Some children have experienced painful shocking sensations. These symptoms are applicable to both adults and children.

You may have been told that the device failed and have never learned why. If that is the case, call us, as we may be able to help.

We work on a contingency fee if we are asked to represent you; there is no fee up front and there are no costs to you unless you recover from a judgment or settlement. There is no money down needed to talk to us.

If you have experienced a cochlear implant failure, we would be honored to speak with you. Tim Edwards’ grandson has a cochlear implant, and Tim is on the Board of Directors of the Memphis Oral School for the Deaf. He and Ed Wallis would be honored to hear your trials and tribulations with this device, and will come to you, if needed, to sit down with you and discuss the failure mode.

IF YOU OR A LOVED ONE RECEIVED AN ADVANCED BIONICS COCHLEAR IMPLANT BETWEEN 2003 AND 2006, YOU MAY BE ENTITLED TO HELP.

Cochlear Implant Injury Recall Attorneys Offering Help to the Injured

April 6, 2010

Firm Offers Free Case Evaluations to the Public

April 6, 2010 — If you have suffered from a recalled Advanced Bionics HiRes90k cochlear implant, we may be able to help you. We have spent years helping others similarly situated to you.  As reported on May 9, 2009, attorneys Tim Edwards and Ed Wallis are offering free case evaluations to the general public for injuries and damages sustained by a failed cochlear implant.

The Advanced Bionics HiRes90k is a medical device that provides sound to deaf and those profoundly hard of hearing. Unfortunately for many, the device was manufactured using a feed-thru component by AstroSeal, Inc. that allowed moisture/vapor to enter the device. This results in most cases in device failure.

The time frame at issue is January 1, 2003 through 2006. If you or a loved one were implanted with one or more cochlear implants by Advanced Bionics during this time frame, and the device has failed, you may be entitled to monetary compensation. We can help, but only if you call us today.

There are signs that the device could be failing, as we have reported previously. Those signs are:

  • Discomfort
  • Ear pain
  • Loss of sound
  • Cracking, hissing and popping noises
  • Sudden loud noises

If you need help, call (901) 527-2125. YOU CAN ALSO FILL OUT THE FORM BELOW TO BE CONTACTED BY AN ATTORNEY FOR A FREE CASE EVALUATION:

Anniversary of FDA Settlement

July 21, 2009

Approximately one year ago, Advanced Bionics, the US manufacturer of cochlear implants, settled a civil suit brought by the U.S. Food and Drug Administration (FDA) based on the HiRes90k cochlear implant device. It is expected over 25% of the vendor B HiRes90k devices (implanted in most part through March 2006) will fail. While public relations campaigns may tell you Advanced Bionics settled to “move on,” you have the option to not “move on” until the company addresses the difficulties you faced in life following a failed medical device.

If your HiRes90k failed, and you sustained emotional or physical injuries, lost wages, medical bills, travel expenses, or any other costs, you may be entitled to recovery from the company and possibly the manufacturer or the defective component (a feedthru manufactured by Astro Seal).

If you received the defective cochlear implant recall letter, you may be entitled to relief.

If you want more information on filing a lawsuit against Advanced Bionics, a cochlear implant manufacturer, you can contact me below.

If you or your child has an Advanced Bionics HiRes90k device that was implanted prior to March 2006 (or was implanted with a Clarion II / CII device) and you or your child is experiencing difficulties with the implant or the device has failed, please email me, call me, or complete the form below. I will contact you as soon as possible:
