A low vitality score, better known as an Apgar score, at birth is a strong predictor of a later diagnosis of Cerebral Palsy according to a new study published on bmj.com. The authors learned that children with an Apgar score of less than 3 at birth had a 100 times more likely chance of developing cerebral palsy than those with an Apgar score of 10. The correlation between a low Apgar and cerebral palsy was highest in children with normal birth weight and modest in children with low birth weight. The study measured these correlations in more then a half million Norwegian children born between 1986 and 1995. Of those children almost 2 in 1000 were given the diagnosis of Cerebral Palsy before they reached the age of 5. The most important conclusion to be drawn from this data is that Cerebral Palsy is closely related to factors that also effect infant vitality, something that has been strongly suspected in medicine for years. The Seattle Post Intelligencer (12/29, Ho) reported, “The family of a woman who died after liposuction at a Bellevue clinic has sued the clinic and doctor who did the procedure, a month after the state charged the doctor with unprofessional conduct.” According to state investigators, Dr. Marco Sobrino “failed to monitor how much Lidocaine” he gave the patient “before sending her home alone in a cab after he was done.” The lawsuit also charged the clinic for misleading marketing materials promoting the procedure as “safe, simple and ‘virtually painless.’” The Post Intelligencer notes the suit against the Sobrino and the Sono Bello clinic “echoes a charging document filed in November by the state Medical Quality Assurance Commission, whose case is pending against Sobrino.”

HealthDay (12/29, Dotinga) reported that “bacteria often contaminate the hands of those who give anesthesia to surgical patients, and those germs contribute to disease transmission during operations,” according to a study published in the journal Anesthesia & Analgesia. After studying 164 operating room procedures involving anesthesia, investigators “discovered that bacteria had been transmitted to the valves of intravenous lines. About half of the time, those germs were detected on the hands of those who provided the anesthesia, such as anesthesiologists and nurse-anesthetists.” Columbia University anesthesiology professor Steven Shafer said “it’s clear that not enough anesthesia providers are disinfecting themselves carefully enough before surgical procedures.” And “Although we know that hand-washing is an important step, our compliance is poor, and there is little excuse for hospitals not implementing systems that facilitate compliance with hand-washing guidelines.”

The Arizona Republic (12/29) reports, “Hospitals can call a preferred private fiduciary that will assess your situation and may petition the court to declare you legally incapacitated.” According to the article, “Fiduciaries, along with probate law firms, often have relationships with hospitals that they have carefully cultivated as part of their marketing strategy.” Although “some hospital officials say their social workers and doctors make decisions in the best interest of patients, they acknowledge some social workers and doctors may have professional relationships with fiduciaries they consider reliable.”

Furthermore, the Associated Press (12/28) reported an Arkansas doctor is being sued for malpractice “for allegedly not performing proper tests before operating on [Christina] Chaffin’s back and failing to tell Chaffin of the risk of surgery.” Chaffin’s suit seeks “$75,000 for the costs of two surgeries and follow-up visits and lost wages plus an amount to be determined by a jury for pain, suffering, and mental and emotional anguish.” The suit recently “ended in mistrial” when the defendant, Dr. Stephen Eichert “treated an ill juror in the courtroom in front of other jurors.”

The Chicago Tribune (12/27, Twohey) reported, “A private program that has long kept secret watch over Illinois doctors receiving substance-abuse treatment is now monitoring health care professionals with sexual misconduct violations – including some convicted of crimes.” Critics of the Illinois Professionals Health Program say “such individuals don’t belong in a program shrouded in secrecy. Sexual misconduct demands disciplinary action, they say, not just treatment. And the public deserves to know who violators are.” An example of the controversy is Dr. Venkatesan Deenadayalu, “who entered the program after he was convicted of sexual abuse and battery of a patient.”

Furthermore, although not in Tennessee, the California Medical Board suspends operations by allegedly negligent surgeon. The AP (12/27) reported the Medical Board of California suspended plastic surgery operations by a surgeon accused of “negligence in the treatment of two patients, resulting in one patient’s death.” Dr. Ehab Aly Mohamed “is also accused of posing as a Harvard professor and telling patients he was enrolling them in a Harvard study, but the board could not find evidence that he has any affiliation with the prestigious school, or that the studies exist.” Medical board executive director Linda Whitney said the “suspension means he cannot perform any cosmetic surgical procedure involving piercing of the skin, among other limitations.”

The Baltimore Sun (12/25, Bishop) reported, “Federal investigators have ordered St. Joseph Medical Center to conduct annual, random audits of its cardiac care practice to verify that the procedures performed there are necessary, in the wake of allegations that Dr. Mark G. Midei placed heart stents in hundreds of patients who didn’t need them.” This “requirement, part of a far-reaching ‘corporate integrity agreement’ imposing greater government oversight of the Towson hospital, also requires St. Joseph to follow strict rules designed to discourage — or catch — kickbacks to doctors and fraudulent treatment and billing.” The Sun pointed out that “the agreement, signed in November, was made public online last week by the Office of the Inspector General of the US Department of Health and Human Services.”

Furthermore, HealthDay (12/23) reported, “Hospital-wide patient death rates may not be a reliable way to assess a facility’s quality of care,” according to a study published in the New England Journal of Medicine. Researchers “compared four measures of hospital patient death rates. They found that the measures yielded both higher- and lower-than-expected rates for the same Massachusetts hospitals for the same year.”

Finally, The Hill (12/25, Pecquet) “Healthwatch” blog reported, “The top Republican on the Senate Finance Committee wants the federal government to explain why the conviction rate for Medicare fraud is largely flat despite the millions recently spent to beef it up.” The Hill said “the Democratic Congress appropriated $198 million in discretionary funds for Medicare fraud prevention last year, on top of an $11 million increase in mandatory spending. But the number of criminal convictions fell slightly that year (from 588 to 583), prompting Sen. Charles Grassley (R-Iowa) to demand some answers in a letter he sent to the heads of the Health and Human Services and Justice departments.”

The Boston Globe (8/2, Saltzman) reports that a Boston medical malpractice lawyer filed last week filed a lawsuit against Beth Israel Deaconess Medical Center on behalf of a patient who underwent “unwarranted” prostate surgery after a hospital pathologist “had mistaken his [biopsy] slides for those of another patient who did have prostate cancer.” Andrew C. Meyer Jr. filed another complaint against a private laboratory in Lexington on behalf of another patient “whose situation was the reverse.” That specimen, which was analyzed by Strata Pathology Services, came back negative, but eight months later “a second biopsy, examined at a different lab, revealed that he had cancer.” Meyer said “the biopsy mix-ups illustrate that mistakes in the lab can also have devastating consequences.”

The Dallas Morning News (8/1, Dunklin, Ambrose) reported that “national medical research increasingly supports the long-held concern that poor supervision of doctors-in-training at teaching hospitals contributes to patient harm, even death.” Two months ago, a study led by University of California-San Diego researchers “reported a 10 percent increase nationally in medication errors that killed patients during the month of July, the traditional start date for new residents.” A 2008 report by the Institute of Medicine “urged that residency programs have ‘measurable standards,’ such as when and how residents consult faculty doctors.” This summer, the Accreditation Council for Graduate Medical Education proposed “updated guidelines that are to be refined before adoption next year.”

The New York Times (10/19, D7, Rabin) reports in Vital Signs that “despite a requirement that hospitals abide by a standard set of procedures to prevent surgical mistakes like operating on the wrong patient or the wrong body part, such errors continue to occur far too often,” according to a paper in the Archives of Surgery. “Past estimates suggested that such mistakes occurred once in every 110,000 procedures, but the paper’s lead author, Dr. Philip F. Stahel, said the incidence might not be so rare — and might even have increased.” He even went so far as to call the “data…shocking.”

The author of the editorial accompanying the study told CNN /Health.com (10/18, Gardner) that “catastrophic surgical errors are ‘a lot more common than the public thinks.’” Martin Makary, MD, of Johns Hopkins University, added, “Each hospital, whether they publicly admit it or not, and whether or not it’s discoverable in a lawsuit, has an episode of wrong-site or wrong-patient surgery either every year or once every few years.” The current study authors decided to look at hospitals in Colorado.

They reviewed cases that were “included in a database of errors doctors reported to the Colorado Physician Insurance Co., or COPIC, between Jan. 1, 2002, and June 1, 2008,” the AP (10/19) reports. “Of the 27,370 incidents in the database, the study found 25 surgeries were performed on the wrong patient and 107 operations on the wrong body part.” What’s more, approximately “one-fourth of those operations inflicted ‘significant harm’ on a patient…and one person died” after suffering “acute respiratory failure” when a “chest tube was placed on the incorrect side.”

The Dallas Morning News (11/17, Dunklin) DMN Investigates blog says, “A new federal report found that 1 in 7 Medicare patients experienced harmful medical care during hospitalization, extending their stays in many cases, contributing to the deaths of some and costing taxpayers hundreds of millions of dollars.” In the report, the “inspector general projected that about 134,000 Medicare patients had endured so-called ‘adverse events’ like medication errors, delays in treatment and surgical mistakes. Another 134,000 experienced what the inspector general termed ‘temporary harm,’ such as prolonged vomiting and hypoglycemia.”

The AP (11/17) reports, “Medicare’s new chief called for more steps to improve patient safety Tuesday, in the wake of a government report that said one in seven hospitalized Medicare patients is harmed during their stay.” Approximately “1.5 percent of those patients, or 15,000 people a month, suffered a complication that contributed to their death, the inspector general for the Department of Health and Human Services said.” In response to the findings, Berwick, who is “a well-known quality-care specialist,” said, “We have to do better.” CMS “unveiled a new Medicare ‘innovation center’ Tuesday designed to develop and test ways to improve quality of care and lower health care costs for everyone, not just Medicare recipients.”

The Hill (11/17, Pecquet) also notes the launching of the new innovation center in its Healthwatch blog, and quotes Berwick as saying, “For too long, health care in the United States has been fragmented — failing to meet patients’ basic needs, and leaving both patients and providers frustrated. … The Innovation Center will help change this trend by identifying, supporting, and evaluating models of care that both improve the quality of care patients receive and lower costs.” Richard Gilfillan, the center’s acting director, “added that the center aims to improve the care of Medicare and Medicaid patients alike by working to ‘identify, validate, and scale models that have been effective in achieving better outcomes and improving the quality of care.”
