Record Damages Awarded in Arizona Nursing Home Lawsuit

The family of a man who died in a Phoenix assisted living facility should receive $11 million in damages, an Arizona jury has ruled. According to the lawsuit, Liberty Manor Residency failed to properly monitor Earl Scherrer and falsified documents related to his care. An autopsy showed that Scherrer died of heart problems caused by ingesting foreign objects. The award is believed to be the largest ever against an assisted living facility.

Tennessee Nursing Homes “Third Worst”

Thirty percent of Tennessee nursing homes get the worst possible rating in a new federal report released today, giving the state a more dismal showing than almost every other state in the nation. Only Louisiana and Georgia have poorer ratings.The first federal effort to rate nursing homes comes from the Centers for Medicare & Medicaid Services and evaluates nearly 16,000 nursing homes nationwide. Most of the 319 Tennessee nursing homes in the report rated well below average, and less than 7 percent were judged well above average.The comparative report mirrors the Zagat restaurant guides, with each nursing home given an overall score of one to five stars, with five stars being the best. Nursing homes also were given specific marks on quality of care, staffing levels and health inspections.

More Claims Added to Nursing Home Suit

A group of Washington state nursing homes took on patients they could not properly care for in order to increase profits, according to a recently expanded lawsuit. In the lawsuit, plaintiffs allege that the homes, run by Milwaukee-based Extendicare Health Services, violated state consumer protection laws and failed to meet health and safety standards governing nursing homes. An attorney for Extendicare maintained that the company takes safety very seriously at its homes.

Violations Reported at 94% of Nursing Homes

This is shocking, and worthy of front page news across the globe. As reported by the New York Times, “More than 90 percent of nursing homes were cited for violations of federal health and safety standards last year, and for-profit homes were more likely to have problems than other types of nursing homes . . . Inspectors received 37,150 complaints about conditions in nursing homes last year, and they substantiated 39 percent of them.”
The U.S. Department of Health and Human Services further found that approximately 17% of nursing homes had deficiencies that caused “actual harm or immediate jeopardy” to patients. The report found numerous issues at the nursing homes, including bedsores, medication mix-ups, poor nutrition, and abuse and neglect of patients. Families entrust nursing homes with their loved ones, and the behavior of these institutions is unexcusable.
