<p>Some Down’s syndrome children have congenital heart disease and need surgery to correct it. Some defects are quite severe and some are actually fatal. Many of these children need glasses and some are visually impaired, even with glasses. Having the child’s eyes tested may be difficult for younger children, because they cannot cooperate with the testing. Hearing may also be abnormal.</p>
<p><strong>Raising a Down’s syndrome child </strong></p>
<p>Raising a Down’s syndrome child is difficult for any parent, but it is especially challenging for a substitute parent. At any age, the child will not be able to tell you much about his history and will not be able to understand the details of what you are trying to ask or tell him. It will require extra patience to work with this child, but the rewards are great. Most Down’s syndrome people are friendly and calm and pleasant family members. School will generally continue past the age of eighteen. Planning for this child, as he becomes an adult, will be very important.</p>
<p><strong>Spina bifida </strong></p>
<p>Spina bifida, a birth defect of uncertain origin, serves as an example. The spinous process, a portion of the vertebrae, is split in children with spina bifida and part of the spinal cord is malformed and may be extruded either into a blisterlike bag or outside it, if the bag has ruptured; hydrocephalus is common. Most frequently, such children are paralyzed and suffer from bladder and bowel infections, malfunction, or incontinence. It is not unusual for them to be mentally retarded. In the past, most spina bifida children died from meningitis after a short life because of the spinal cord&#8217;s continual exposure to infection. Today, however, medical technology can sustain the life of many children who previously would have died. Modern techniques include straightening the spine, closing the lesion, draining the hydrocephalus if one has developed, and eliminating infection through medical treatment. The result is that a large percentage of the children having spina bifida survive, but a large number of them are physically handicapped and mentally retarded.</p>

<h2>The Problem</h2>

<h2>About Wellbutrin</h2>
<p>Wellbutrin is an antidepressant drug prescribed to treat <a href="http://www.mayoclinic.com/health/depression/DS00175" target="_blank">major depressive disorder</a>, also called major depression and clinical depression, and <a href="http://www.mayoclinic.com/health/seasonal-affective-disorder/DS00195" target="_blank">seasonal affective disorder</a>, a type of depression involving adverse side effects that occur each year during the same season. First approved by the FDA in 1985, bupropion hydrochloride was available for several years only under the brand name <a href="http://www.accessdata.fda.gov/scripts/cder/drugsatfda/index.cfm?fuseaction=Search.SearchAction&amp;SearchTerm=wellbutrin&amp;SearchType=BasicSearch" target="_blank">Wellbutrin</a>. In 1996, the FDA approved a sustained-release tablet of this drug called Wellbutrin SR and, in 2003, approved an extended-release tablet known as Wellbutrin XL.</p>
<p>Wellbutrin carries a Pregnancy Category C classification, meaning that animal reproduction studies have shown an adverse effect on the fetus but that no adequate or well-controlled studies in humans have been performed.</p>
<p>Wellbutrin has been <a title="null" href="http://www.reuters.com/article/idUSTRE6433FN20100504" target="_blank">linked to congenital heart defects</a>. Congenital heart defects <a href="http://tchin.org/aware/index.htm" target="_blank">affect approximately 40,000 babies</a> each year, and one of the primary known causes of such birth defects is the ingestion of teratogenic drugs during pregnancy. A teratogen is a drug or other substance capable of interfering with the development of a fetus that can ultimately result in serious birth defects.</p>
<h2>Alleged Birth Defects</h2>
<p>Anti-depressants have become a troubling subject when it comes to teenagers; however, some mothers are unfortunately giving birth to children with birth defects that may be connected to taking drugs called Selective Serotonin Reuptake Inhibiters (SSRIs) during early pregnancy.</p>
<p>SSRI birth defects, which include heart problems, spina bifida, club foot, cleft pallet, and others, are causing concerning and leading to litigation filed against the makers of these dangerous drugs.</p>
<p>Complaints of SSRI birth defects have been identified since at least 2005 from women who ingested during early pregnancy, Zoloft, Celexa, Lexapro, Paxil, Prozac, and Wellbutrin while pregnant. SSRI drugs are generally used as anti-depressants or to stop smoking.</p>
<p>A New England Journal of Medicine study found that women who took SSRIs during third trimester were six times more likely to deliver babies born with primary pulmonary hypertension (PPHN) than those who did not take the SSRIs during their third trimester.  PPHN is a lung disorder that restricts the arteries and causes blood pressure in the pulmonary artery of the heart to rise beyond control.</p>
<p>Symptoms of PPHN may include the following:  heart murmurs, rapid heart rate, bluish skin, low blood oxygen levels, difficulty breathing diagnosing PPHN.</p>
<p>PPHN is a serious birth defect.  Even after treatment, infants can be susceptible to heart failure, brain hemorrhage, seizures, kidney failure or organ damage.  Some of these birth defects can be present throughout life or even fatal.  Some infants who happen to survive PPHN nevertheless have long term breathing difficulties, seizures, developmental delays and hearing loss.</p>
<p>Zoloft, Celexa, Lexapro, Paxil, Prozac, Wellbutrin and Zyban are anti-depressants or smoking sensation drugs that have fallen under close scrutiny for use by expectant mothers.  As consumers of prescriptions drugs, our society assumes that pharmaceutical companies test for the safety as well as the effectiveness of prescription medication.  Unfortunately, there are and have been several drugs on the market that can cause injury, illness or even death.  In these cases, the negligence of a pharmaceutical company may warrant a personal injury lawsuit.</p>

<h2><strong>Mirena Injuries</strong></h2>
<p>Mirena is alleged to have many side effects. Mirena is an interuterine contraceptive device {IUD}. One such side effect is <strong>perforation of the cervix</strong>.</p>
<p><strong>Mirena</strong><strong> </strong>has a small amount of synthetic progesterone hormone that goes into the wall of the uterus. Women who use the Mirena device have lighter, less painful menstrual periods. Some women may have light, irregular bleeding or spotting throughout the cycle. Others have no menstrual periods at all. A few women have mood changes, less enjoyment of sex, or headaches due to the hormones in Mirena, but this is not common.</p>
<p><strong>Uterine Perforation</strong></p>
<p>Another side effect of using the Mirena device is uterine perforation. The main dangers of such uterine perforation include bleeding and trauma to the abdominal viscera as well as damage to internal organs such as bowel, omentum, mesentery, ureter and fallopian tube.</p>
<p><strong>Fertilization</strong></p>
<p>The fallopian tubes are an integral part of the reproductive system. It plays an important part in the woman becoming pregnant. She must have at least one functioning fallopian tube. Typically she will ovulate every twenty-eight days or so, and this will take place towards the middle of the cycle when the mature egg will be released from the follicle on either her right or left ovary. The fallopian tube will pick up the egg which will start a slow journey down it. Within twenty-four hours of release, the egg will be positioned ready to receive sperm. After sex, sperm are normally deposited at the cervix in hundreds of millions. The sperm that arrive at the ampulla, the site of fertilisation, must have undergone an epic journey through the cervical mucus, across the uterus and through the fallopian tube. Once the sperm finds the egg, it will penetrate the egg. Fertilisation has occurred and the fertilised egg, now described as an embryo, will begin to grow. Within forty-eight hours, the embryo will have divided twice to form a four-cell embryo. At this stage the embryo is still located in the fallopian tube.</p>
<p><strong>Infertility</strong></p>
<p>Any damages to or defect in the fallopian tubes can cause infertility in the woman. Women use the Mirena device as a contraceptive to prevent pregnancy but they can remove the device if they intend to get pregnant. However if the Mirena device has perforated the uterus and the uterine perforation has caused damage to the fallopian tubes, then the woman suffer from infertility and will have problems getting pregnant.</p>

<h2>Side Effects</h2>
<p>Some women who have had <strong>Mirena</strong> implanted experienced serious and even debilitating or life-threatening side-effects. The device may <strong>migrate</strong> from its original position after being inserted, <strong>perforating the uterus</strong> or embedding <strong>itself in the uterus</strong>. In both instances, a doctor must locate and surgically remove the device. Mirena may also <strong>migrate outside the uterine cavity and cause adhesions or scarring that can lead to infertility</strong>. Depending on the damage caused, affected women <strong>may require a complete hysterectomy</strong>, and more serious complications could result in <strong>death</strong>.</p>
<p>Serious side effects that have been linked to Mirena include:</p>
<ul>
<li>- Abscesses</li>
<li>- Embedment in the uterus</li>
<li>- Erosion of adjacent areas such as the vagina</li>
<li>- Infertility</li>
<li>- Inflammation of the membrane that lines the abdominal cavity and internal organs (Peritonitis)</li>
<li>- Intestinal perforations or obstruction</li>
<li>- Pelvic Inflammatory Disease</li>
<li>- Perforation of the uterus</li>

<h2>Women Experience Pain</h2>
<p>From a medical standpoint, when pain occurs following the implantation of a transvaginal mesh (TVM) device, it is generally secondary to the mesh being placed too tight or healing in a position that is pulling on the muscles and nerves that are causing irritation. It can also occur if the mesh is not lying properly. In these situations, sexual intercourse becomes painful and uncomfortable. Life also becomes difficult.</p>
<p>When this occurs, many physicians will employ a conservative approach. Conservative therapy includes pelvic floor physical therapy (manual therapy on the muscles and nerves in the vagina to help relax and/or relieve spasms that may be causing pain). Some women have described temporary relief having undergone physical therapy for this, but find that the problem simply recurs once there therapy ends.</p>
<p>Another option are trigger point injections (TPIs).  Trigger point injections into the muscles or nerves in the vagina that may be causing the pain is another approach. If the pain persists and doesn’t respond, surgery may be necessary.</p>
<p>In severe cases an abdominal approach will be necessary to take care of pain. If this is the case, most surgeons recommend major surgery with a large abdominal incision. This can obviously be extremely painful to the patient, and cause life-disrupting complications. It is important to note that with any pelvic surgery, pain can be a complication whether mesh is used or not.</p>

<h2> The Problem</h2>
<p>In 2008, the FDA first released concerns about the safety of transvaginal placement of mesh. From 2008 to 2010, the FDA received three to five times as many adverse reports associated with mesh used for pelvic organ prolapse repair than what agency received from 2005 to 2007 (nearly 1,000 reports of adverse events were received from 2005-2007).</p>
<p>Many of these patients complain because of erosion or contraction of the mesh material (which has been described as being of a similar material as Rubbermaid storage containers).  The erosion leads to bleeding, severe pelvic pain, painful (or impossible) sexual performance and a recurrence of urinary problems.</p>
<p>In July 2011, the Food and Drug Administration (FDA) issued an update related to what it called &#8216;serious complications&#8217; related to the use of vaginal mesh for treatment of pelvic organ prolapse (POP) and stress urinary incontinence (SUI).  It is now known that complications linked to transvaginal placement of surgical mesh in SUI and POP patients are not rare and can require multiple surgeries to correct problems related to the use of surgical mesh. In fact, the FDA now says that additional surgeries may actually not be able to repair damage caused by implantation of the mesh.</p>
<p>In other words, the side effects of the mesh placement may be permanent.  These complications from transvaginal placement of surgical mesh include:</p>
<ul>
<li>-Erosion of the implanted mesh</li>
<li>-Infection and/or bleeding</li>
<li>-Pain, including pain during sexual intercourse</li>
<li>-Problems with organs near the implantation site</li>

<p>Following the FDA&#8217;s new safety announcement concerning the link between Topamax and oral cleft birth defects, the Consumer Justice Foundation developed an educational resource to provide mothers with more information about Topamax birth defects. According to this recent FDA action, there is an increased risk of oral clefts like cleft lip and cleft palate among infants whose mothers take Topamax while pregnant (fda.gov). <p>Topamax is a prescription anticonvulsant drug, currently manufactured by <strong>Ortho-McNeil Pharmaceutical</strong>, a division of pharmaceutical giant <strong>Johnson &amp; Johnson</strong>. Although anticonvulsant drugs were originally designed to treat epilepsy specifically, many of these medications have been indicated for additional purposes in recent years. The FDA approved Topamax, for example, in 1996 for the treatment of epilepsy, and again in 2004 for the prevention of migraine headaches. Since its introduction to the U.S. market, Topamax has become one of the most commonly prescribed anticonvulsants available.</p>
<p><strong>Cleft lip and cleft palate</strong> occur when a child&#8217;s oral structures fail to develop properly in utero. Cleft lip is characterized by a vertical fissure in the upper lip which may extend up through the nose. Cleft palate can vary in severity from a small opening at the back of the mouth to a nearly complete separation of the roof of the mouth. Children born with cleft lip or cleft palate may struggle with severe side effects like feeding difficulties, recurring ear infections, dental problems, hearing loss, and delays in speech and language development.</p>

<p>Attorneys Tim Edwards and Ed Wallis of the firm Glassman, Edwards, Wade &amp; Wyatt have filed two lawsuits in Los Angeles Superior Court on behalf of their injured clients surrounding the twice recalled <a href="http://www.midsouthtriallawyer.com/cochlear/" target="_self">Advanced Bionics HiRes90k cochlear implant</a>. The lawsuits filed allege wrongdoing by the cochlear implant manufacturer for the manufacture and sale of the device, which has been marketed as the most reliable cochlear implant in the world.</p>

According to the survey, conducted by TrialGraphix / Kroll Ontrack, 90 percent of adults eligible for jury duty felt that subprime lenders knowingly abandoned sound practices to lend money to people who could not afford it while 70 percent of respondents said they would be sympathetic to claims from those who alleged they were deceived by subprime lenders.</p>
<p>Expect lawsuits against mortgage lenders to begin rolling in over the next year.</p>
