Statistics

Millions of people are injured in motor vehicle accidents each year – many very seriously. According to statistics provided by the National Highway Traffic Safety Administration, someone in the United States is involved in a car accident every 10 seconds. In 2008, an estimated 37,261 people were killed and 2,350,000 people were injured in traffic accidents. Here are some other startling facts:

  • Motor vehicle crashes continue to be the leading cause of injury death in the United States for people ages 3 to 33.
  • Motor vehicle crashes took the lives of 1,633 children (ages 1 to 15) and 4,497 teenagers (ages 16 to 20) in 2008. Older adults (over 65), with 5,533 deaths in 2008, continue to be a high-risk age group for motor vehicle fatalities.
  • In the United States, 4,378 pedestrians died from traffic-related injuries and another 69,000 sustained non-fatal injuries in 2008.
  • In 2008, 32% of traffic fatalities were alcohol-related. Either the driver or an affected person (e.g., a pedestrian or bicyclist) had a blood alcohol concentration (BAC) of at least 0.08 grams per deciliter (g/dl).

Potential Damages

We seek justice for our clients against Defendants who fail to follow the Rules of the Road. Some damages you may be entitled to include:

  • Medical, hospital and pharmacy bills
  • Pain and suffering
  • Mental distress
  • Loss of enjoyment of life
  • Permanent injury
  • Lost earning
  • Future lost earnings
  • Loss of consortium
  • Punitive damages in certain cases

Uninsured Motorist

Your motor vehicle insurance coverage may protect you against negligent drivers who do not have insurance. The provision in your policy is known as uninsured motorist protection. This coverage may also apply if the other driver has too little insurance. In that case, it is known as underinsured motorist protection. In order to gain the benefit of these insurance provisions, it is imperative that you notify your insurance company promptly concerning an accident. Therefore, even if you think the other driver is adequately insured, it is important to notify your insurance company. In that way you will be assured of the coverage if it turns out that the other driver’s insurance is not what you believed it to be.

Limitations Period

Tennessee law gives you one year from the date of accident in which to file your lawsuit for bodily injury. You have three years to file for property damage. It is for this reason it is important to contact us today before the statute of limitations period expires.

Our Fee

We do not charge a fee unless you recover damages either through settlement or verdict.
