Student Sexual Assault
The primary goal of a school system should be the safe education of a child. Too often, school systems fail to ensure that safety remains paramount to all else. All across the country, administration, staff and teachers are suspected of and all too often linked to actual sexual contact with minor students. Some of this sexual contact is on school property during school hours.
Simply stated, there is no excuse for any sexual contact between an educator and a child. Period. Parents entrust their children each and every day to school systems. This trust extends from the Superintendent and continues from those employed at the Board of Education to the principals to the teachers themselves. When that trust is violated, children are at risk.
This trust is not only violated when an adult forces himself or herself on a child, but also when a teacher turns a blind eye to a dangerous situation in a classroom.
We have represented children who have been the victim of sexual abuse by a teacher. There are several different means by which a student can seek justice for their injuries, including a suit for negligence against the School System under the Tennessee Governmental Tort Liability Act (GTLA), or a lawsuit in federal court against the School System and possibly others under Title IX and Section 1983. We have filed lawsuits against both the Shelby County Board of Education and the Board of Education of Memphis City Schools.
